This privacy policy sets forth the practices of National Sweepstakes Company, LLC (“NSC”) in collecting, using and sharing information provided by persons via this website.
Agreement
By submitting personally identifiable to NSC on or through the website, the website visitor expressly understands and agrees to the terms of this Privacy Policy. IF YOU DO NOT AGREE TO THE PRIVACY POLICY, DO NOT SUBMIT ANY PERSONALLY IDENTIFIABLE INFORMATION (AS DEFINED BELOW) ON OR THROUGH THE WEBSITE.
Information Collection
Visitors to the website may use the website without providing any personally identifiable information (such as, a person’s name, business name, e-mail address and daytime phone number). However, if website visitors refrain from providing personally identifiable information, certain content/features of the website may not be available to them.
Currently, NSC collects personally identifiable information only from website visitors who either; (a) inquire about possibly hiring NSC to handle promotion (e.g., sweepstakes and contest) administration and related needs, via the Request Quote function on the website, (b) submit their email address to receive newsletters, via the Subscribe to Newsletter function or (b) wish to post a comment/reply to a blog posted on the website. If you do not wish to engage in either of the above activities, please do not provide any personally identifiable information on or through the website.
In compliance with the Children’s Online Privacy Protection Act (“COPPA”), NSC will NOT knowingly collect personally identifiable information from persons under the age of 13. If NSC discovers that someone under the age of 13 has provided personally identifiable information, it will be deleted as soon as reasonably practicable.
NSC may also automatically collect non-personally identifiable information in conjunction with a person’s visit to the website; such as, browser type, operating system and Internet Protocol [“IP”] address. NSC uses “cookie” technology: a small text file that is stored on the user’s computer by a website. Among other functions, “cookies” store a website user’s preferences and settings so as to enhance the user’s experience in using the website. Information Use
NSC will use personally identifiable information collected from website visitors solely for the purpose collected (i.e., responding to the inquiry about possibly hiring NSC and determining suitable services for a prospective client or in conjunction with possibly posting a comment/reply to a blog/send periodic newsletters, as the case may be), unless the box is checked indicating that the user would like to receive future communications from NSC. If NSC is interested in perhaps using a website visitor’s personally identifiable information for any other purpose, NSC shall secure the written consent of the website visitor prior to doing so.
NSC may also combine personally identifiable information collected on or through the website with information NSC has collected via other sources.
NSC will use non-personally identifiable information for a range of analytical and recordkeeping purposes; among other objectives, the non-personally identifiable information may be used by NSC to gauge the effectiveness of the website and improve the functioning of the website. It should be emphasized that non-personally identifiable information is, by definition, anonymous and cannot be used to identify a particular website visitor.

Personally identifiable information collected from website visitors will be used solely by NSC for its own purposes and will NOT be sold or shared with any third party, subject only to the following limited exceptions:

(b) should NSC determine in good faith that disclosure is necessary so as to protect the Company’s rights or the safety of a website visitor (e.g., to address suspected fraud);
(c) If NSC is involved in a merger, acquisition or the sale of all or a portion of its assets.
Security
NSC is committed to taking reasonable steps to ensure the security of your information. To prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of information, we have put in place appropriate procedures to safeguard and secure the information we collect, in line with prevailing standards in the promotion marketing industry. NSC cautions, however, that no security procedure is 100% safe and secure.
Foreign Users/Information Stored in the U.S.
The servers that make this website available and store information collected on or through the website are located in the United States. Persons located outside of the United States should be mindful that their personally identifiable information will be transferred to the United States and that the United States may not feature the same degree of protection of information as the laws of their home country. By submitting personally identifiable to NSC on or through the website, the website visitor expressly understands and agrees to the transfer of his/her personally identifiable information to the United States.
Additional Conditions Regarding Posting Comments/Replies to Blogs
A website visitor must provide personally identifiable information (his/her full name and e-mail address) in order to submit a comment/reply to a blog for possible posting. Your comment/reply will be attributed to you based on your first name only; your name and e-mail address will not be disclosed publicly.
You shall fully and truthfully identify yourself to NSC if interested in posting a comment/reply without misrepresentation of any kind. Without limiting the preceding, do not impersonate other persons relative to posting comments/replies.
The content of the comment/reply shall not:
(1) Be offensive, abusive, harassing, profane, threatening, unfit for publication, defamatory or tortious;
(2) Violate the intellectual property or other rights of any third party, including rights of privacy, publicity, rights of trademark or copyright, nor shall it suggest a connection or affiliation with another person or entity which does not exist;
(3) Include any content that is of a confidential nature or a trade secret (and you understand and agree that NSC does not have any fiduciary duty, duty of confidentiality or the like to you with respect to your comment/reply);
(4) Include SPAM, any commercial advertisement, charitable solicitation, the solicitation of funds/donations, or otherwise promote any commercial or non-profit/charitable entity;
(5) Advocate violence, illegal gambling/wagering, or any act which is illegal under local, state, federal or other law.
In all cases, the user bears sole responsibility for the content of any comment/reply that he/she posts on the website. NSC is functioning as a passive conduit for the posting user comments/replies. NSC EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY IN CONJUNCTION WITH THE CONTENT POSTED BY WEBSITE USERS AS COMMENTS/REPLIES, INCLUDING ANY DUTY TO FILTER, MONITOR OR REVIEW SUCH CONTENT.
Accordingly, website visitors are expressly cautioned not to rely on the accuracy, currency or comprehensiveness of any content (including but not limited to user comments/replies) posted on the website.
THE VIEWS AND OPINIONS OF WEBSITE USERS ARE THOSE OF THE WEBSITE USERS ALONE AND DO NOT REPRESENT THE VIEWS/OPINIONS OF NSC. NSC WILL NOT EDIT OR MODIFY WEBSITE USER COMMENTS/REPLIES PRIOR TO POSTING THEM.
You shall not upload any material which includes viruses, worms, spyware, malware, Easter Eggs, time bombs or other codes, files or programs designed to interrupt, destroy, limit, seize, control or override the proper intended functioning of the website.
Should NSC determine in its sole discretion that a comment/reply is in violation of these Additional Conditions, NSC will use commercially reasonable efforts to remove the comment/reply from the website. NSC expressly disclaims any liability relative to the removal (or conversely, failure to remove or any delay in removal of) any comment/reply. The removal of a violative comment/reply shall not represent the sole remedy available to NSC under such circumstances. Without limiting the foregoing, NSC may initiate legal proceedings under civil and/or criminal law so as to protect its rights.
In posting a comment/reply, you grant NSC and its designees a royalty-free, irrevocable, perpetual, worldwide, sub-licensable, non-exclusive license to the comment/reply, with the understanding that NSC may use, perform, exhibit, reproduce and/or otherwise exploit your comment/reply in any manner and in any and all distribution channels, venues or media now known or hereafter devised (i.e., in addition to the website itself), without further notice or any compensation. In addition, you waive any “moral rights” that you may have in the comment/reply. You also understand and agree that NSC has wide access to literary/written materials and that the content of the comment/reply may be similar (or even identical to) content that NSC’s employees created or that was submitted to NSC by outside sources, and you release and agree to hold harmless NSC from any liability in conjunction therewith.
Notice and Procedure for Making Claims of Copyright/Intellectual Property Infringement
If you believe that, in a comment/reply to a blog posting, your work has been copied so as to constitute copyright infringement or your intellectual property rights have otherwise been violated in conjunction with a comment/reply to a blog posting, please provide NSC with a notice containing the following information:
(a) Electronic (or physical) signature of the person authorized to act on behalf of the owner of the copyright (or other intellectual property interest);
(b) A description of the copyrighted work (or other intellectual property interest) that you claim has been infringed;
(c) A description of the material which you claim is infringing the copyrighted work (or other intellectual property interest) and where it may be found on the website;
(d) Your address, telephone number and e-mail address;
(e) A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner (or owner of other intellectual property interest), its agent or the law;
(f) A statement by you that the above information in your notice is accurate and that you are either the owner of the copyright or other intellectual property interest in question or are authorized to act on such owner’s behalf.

After receipt of a properly completed notice, NSC will promptly remove the material claimed to be infringing the copyrighted work (or other intellectual property interest) and notify the person who posted such allegedly infringing material.
Changes to Policy
NSC may make material changes to this Privacy Policy from time to time. Website visitors are therefore encouraged to review the Privacy Policy periodically. In the event of a material chance to the Privacy Policy, NSC will post a notice on the website. Such notice will be posted for two (2) weeks from the date of the material change.
